I am a practicing real estate attorney and I have reviewed the
proposed "simplification" of the RESPA rules. Many of these proposals will be
confusing and will cause the general public to become very irritated. The time to
complete a closing will probably double. I will have many clients angry at me and
at the system. Many of my clients are sophisticaed business people and the
requirement to read a "closing script" to these people will be considered an
insult. I believe that I presently explain in detail (without a script) the terms of a
mortgage to my clients. I am also concerned that in areas where attorneys do not
do the closings you will have lay people who are giving legal advice.
This needs to have an opt out provision. Most people do not like to be spoke to
like they are in grade school. This was the feeling I got when I read the script.
Just the idea that there must be a "Closing Script" is demeaning to me, to my
clients and to the system.
