All references to “Shared Responsibility Payment” should be changed to “Shared Responsibility TAX.” While I’m sure politicians and regulators spend a great deal of time arriving at cutesy names and acronyms for legislation, it is problematic when the cutesy names are deceptive. The Supreme Court of the U.S. determined the Shared Responsibility Payment “looks like a tax” and since its collection is administered by the IRS, it is reported on and paid when filing federal tax returns, and it is calculated based on factors such as the amount of taxable income, number of dependents, and tax filing status, the name of the payment should reflect that it is a TAX!
