ACTION: Interim final rule; request for comments. With regards to the following section of the following document. We believe that there is a typographical error on Page 5016, within the ”Impaired driving countermeasures grants” portion of the document. The text from the Federal Highway Bill (Sec 31105, under the "Impaired Driving Countermeasures" subsection clearly delineates, ‘‘(I) at least twice per day; ‘‘(II) by continuous transdermal alcohol monitoring via an electronic monitoring device; ‘‘(III) by an alternate method with the concurrence of the Secretary In "Interim Final Rule: request for comments", the lack of a comma between the word “day” and “by” in the sentence below “ Be subject to testing for alcohol or drugs at least twice per day by continuous transdermal alcohol monitoring via an electronic monitoring device, or by an alternative method approved by NHTSA” gives the sentence a completely different meaning and does not reflect the original intent of the Federal Highway Bill nor how currently running 24/7 programs use twice a day testing as the backbone of their programs. It is our belief that this is a simple typographical error \and that a comma needs to be inserted so that the corrected sentence reads, “ Be subject to testing for alcohol or drugs at least twice per day, by continuous transdermal alcohol monitoring via an electronic monitoring device, or by an alternative method approved by NHTSA”
