A final rule revising § 72.212(b)(5) is before the Commission in SECY-08-0099 (Final Rule - Power Reactor Security Requirements). With the staff's proposed relocation of the provisions of § 72.212(b)(5) to paragraph (b)(9) in this draft proposed language, the draft language for § 72.212(b)(9) should be adjusted to be consistent with the final language approved by the Comission under the power reactor security final rule.
