The current language of the rule does not address a specific remedies for consumers that can be addressed in a court of law in his home state when he has been victimized by unfair and deceptive practices of companies regulated by the rule. Under current practices in the State of Arizona, a major insurer/holding company, State Farm Mutual Automobile Insurance Company is operating in our state, sharing personal nonpublic consumer information, and putting consumers at substantial risk for identity theft without consequence. The company has not recorded its corporate records with the Arizona Corporation Commission, and the state will not help consumers enforce the rule or penalize the company for violating its privacy policy. There must be language to address the lack of enforcement at the state level.
