Our comment is with regard to this sentence in the proposed regulation: "To implement this commitment, the Contractor shall ensure, to the maximum extent possible consistent with applicable law, the fair inclusion of minorities and women in its workforce." We suggest that, after the word "law," this phrase be inserted: "including Title VII of the 1964 Civil Rights Act" ....
The notice earlier notes the applicability of this statute in this context, and we think it is important to make that point clear in the regulations themselves. This is particularly true since there is a danger that, in their efforts to be inclusive of minorities and women, contractors might discriminate against men and nonminorities, in violation of Title VII.
