TTB's Notices 77 is not acceptable. This proposed rule would have the agency
bending over backward to allow two wineries to continue to mislead the public by
using the name Calistoga when their wines are not produced from Calistoga
grapes. These wineries complained to the TTB about the proposed Calistoga AVA
only after the public comment period for that proposal closed. They had their
chance to make their case just like everyone else and they missed it. That
should have ended the discussion, but instead the TTB held up the approval of
the Calistoga AVA, and now brings us Notice 77 which would allow these wineries
to continue using their names despite not using Calistoga grapes.
TTB Notice 77 should be withdrawn and the original Calistoga AVA proposal approved.
