The proposed rule requires electronic submission (presumably via internet) of
passenger manifests for private aircraft leaving foreign destinations for the US 60
minutes prior to takeoff and receipt of entry permission prior to takeoff. The rule
does not take into account the realities of communications between the US and
countries such as Mexico. My wife and I fly volunteer missions to staff medical
and dental clinics in some of Mexico's neediest areas. Although our return flights
depart from a Mexican International airport, there is literally no means of
complying with this rule. There are no public internet access points at the airport,
and it inconceivable that Mexican authorities would allow us to borrow their own
computers (if, indeed, they exist--the Mexican officials type our entry and exit
documents on manual typewriters using carbon paper). This is well-intentioned
rule fails to account for the realities of flight to and from less wealthy countries.
Organizations such at Flying Samaritans and Baja Bush Pilots should be
consulted to determine if there is an alternate, workable means of complying with
the intent of this rule.
