Dear Sir or Madam:
We have current regulations that allow for due process relating to brokers licenses. CBP should revise the proposed regulation to ensure that suspension or revocation of an entry filer code will never occur until meaningul due process procedures have been followed.
The termination of a filer code is a termination of the brokers business. I have personally experienced CBP turning off my filer code in ERROR and can tell you it is devastating to a small business.
At a minimum, the procedures for terminating an entry filer code should match those provided to ABI participants, including a probationary status prior to any suspension as set out in 19 CFR 143.6 (a).
