I am writing to respectfully request a public hearing on the proposed security
zone in Nawiliwili Harbor on Kauai. I believe that the questionable legality of
such a move needs to be discussed. I also feel that it would be wise to discuss
the ramifications of the zone vis-a-vis several possible outcomes. For example,
if there is a confrontation, what is the liability of the Coast Guard members?
What about the protesters who believe they are enforcing the law? Is the Coast
Guard really willing to us force on these citizens, and if they do, what next? I
think such a confrontation is very likely, and at the least it should be
discussed in a public hearing.
That said, I would like to add my personal opinion that this security zone is
unethical and illegal, insofar as it is being created strictly to enforce an
illegal operation of the Superferry. Te Supreme Court has ruled that it is
illegal, and it could not be more clear. I believe that under the guise of
providing "security", this zone is really only adding financial security to the
Superferry investors. We are not terrorists. We wish no harm to the boat, its
crew or passengers, or to the Coast Guard. We are simply peaceful citizens
enforcing the law as we see fit, as it is not being enforced for us.
