This is not proper because immediate action is only required because the city of Bullhead City made application to the Coast Guard at the last minute. Denying their request and not closing the river would be the logical action to take when an application is not made in a timely manor. Good cause does not exist for not publishing a notice of proposed rulemaking (NPRM) with respect to this rule because the reason provided is inadequate: "publishing a NPRM would be impracticable since immediate action is needed to provide for the safety of the participants, crew, spectators, sponsor vessels, and other vessels and users of the waterway during the Regatta event." Immediate action is only required because of a late application. The City of Bullhead City can reschedule their event and make application in time to allow for NPRM. "the safety of the participants, crew, spectators, sponsor vessels, and other vessels and users of the waterway" is not a concern if you deny the application and request the City of Bullhead City to cancel their hazardous event. This event has caused deaths in the past and a temporary safety zone will not prevent deaths. To prevent deaths, the most prudent action would be to prohibit the sale of alcohol on the land based portion of the event. Many participants have been drunk in previous years and Bullhead City makes no effort to prevent this. In fact, they promote it by profiting from the sale of liquor. The city receives a percentage of revenue from the privately run alcohol sales booths at the event. Please withdraw this temporary final rule and only make such rules after public meeting or proper time allowed for public comment and consideration.
