On furthur review of Docket No. USCG-2011-1159 I do not agree that the Coast Guard has met, complied with, or are exempt from DHSMD 023-01, CI M16475.ID, NEPA (42 U.S.C. 4321-437)f. I do not see a final "final environmental checklist" nor a categorial exclusion Determination anywhere. The temporary interim rule also is in violation of federalism and the unfunded mandates reform act. No documents have been produced for the public that provide any cost analysis associated with the interim rule to exempt the requirements. The interim rule is not exempt from regulatory action under section 3f of Executive order 12866. The interim rules does have implications of violation to native Hawaiian rights and privilages.
