Navy Exchange Service Command, a NAFI retail organization, is responsible for paying its own claims from NAF, not APF, and has been investigating and negotiating its own claims for decades, with minimal oversight by JAG. NEXCOM believes that the types of "claims" that it receives are primarily customer service issues that do not rise to the level of a "claim" for JAG involvement and should, instead, be handled internally in order to maintain the important relationship we have with our customers. NEXCOM always involved JAG when NEXCOM denied a customer's request for resolution or the request could not be settled internally. NEXCOM believes that the proposed changes in RIN 0703-AA80 evidence an effort to change this practice when NEXCOM wishes, instead, to continue being primarily responsible for the investigation and negotiation, with minimal assistance from JAG.
