Public awareness and understanding of how combat effects the psychological well being of those involved is very low. There has been however, a significant increase in diagnosed cases, many that result in death of the veteran well after combat. I would ask that the provision include specific language to include PTSD related deaths for those who have been clinically diagnosed as a result of qualifying combat action.
While the temptation and legal obligation suggests that distribution of any refunds go directly to the deceased's estate or next of kin, the deceased may have appointed a friend or family member as their next of kin and left their spouse the dept. The person responsible for the debt should be provided any refund.
The implementation of this change will be critical. Systems must be put in place to minimize or eliminate debt-related contact to the family of the deceased. The ideal process would include the case having already been reviewed, approved, and benefit message included to the family during the notification of death by the Department of Defense.
Since this provision also includes refund to families of deceased who may have qualified had this already been law, it is important that the VA engage the public and families directly to let them know a refund may be possible and provide information on how to maneuver the process.
While this provision covers debt owed to the VA, I believe all debt should be forgiven for people who qualify for this benefit. If society can bail out negligent and irresponsible companies and agencies, we must bail out those who have paid the ultimate sacrifice and who truly deserve America sharing their burden. This is the least society can do to pay respect to the fallen.
