MISQUOTE OF STUDY RESULTS:
The VA is misquoting the study results, there was no limitation on when the depression or seizures manifested. The study actually stated that they might manifest at any time during the TBI sufferers lifespan.
ARBITRARY PROHIBITION TO SERVICE CONNECTION:
Therefore it is an unconstitutional, arbitrary and capricious limitation to demand that the symptoms manifest within a specific period of time since separation from service to be considered service connected.
NO TIME LIMITATIONS:
There must be NO limitation on the time in which the symptom choose to manifest itself.
NO SERVICE PERIOD LIMITATIONS:
There must be mo limitation om which periods of war or service this change applies, all Veterans of all periods of service are equally effected by TBI's whether we knew about the lifelong effects at that time or not.
ALL VETERANS, ANY TBI, ANY SYMPTOM TO BE PRESUMPTIVE:
ALL Veterans with a record of a TBI and any one of the presumptive symptoms manifesting at any point in their life MUST be presumptively service connected if claimed.
THESE are matters of the Cosntitutional equality of care for all Veterans.
