We employee many in this particular position. While I agree in principal we currently are not funded by the Medicaid waiver to pay overtime. The effect of this change, were it to enacted, would be to lower individuals' pay as we would have to limit their work to 40 hours per week. Many now work 60 or more and are paid straight time. So they might lose 20 hours of pay from us and would have to pick that up from another employer. That would cause disruption to the individual being cared for and force care givers to work for multiple companies. Believe me - with the funding the way it is, from all sources including private payment there will not be overtime paid by companies. Keep in mind as well - most often these are individuals caring for an individual or a couple of individuals and there is time where they are watching TV, driving the individuals or other activities which are not stressful or physically demanding. Please think this through - a change might parcipitate more harm than good.
