The comment period for Notice No. 106 has been reopened until October 24, 2011 (see Notice No. 120) in order to solicit comments on certain issues raised in the comments received on Notice No. 106, as well as to solicit comments on the results of preliminary laboratory analyses conduced by TTB (see the "TTB Laboratory Comparison of Pipe and Roll Your Own Tobacco Products" document posted within this docket).
As originally published, Notice No. 106, an advance notice of proposed rulemaking, requested public comments on standards that could be used to distinguish between pipe tobacco and roll-your-own tobacco for Federal excise tax purposes based upon certain physical characteristics of the two products. TTB also requested comments on any other physical characteristics that may be used for such purposes.
