Title: Comment 9: Pipe Tobacco Council, Inc. (Sharp, Norman F.)
Abstract: This comment, dated September 20, 2010, from the Pipe Tobacco Council describes six different physical characteristics of legitimate pipe tobacco and proposed four objective and enforceable standards: (1) total reducing sugars by weight, (2) moisture content by weight minimum, (3) a tobacco cut meeting or exceeding 1/6th of an inch in width, and (4) measuring the height of pressed tobacco pieces. Commenter proposed that the final rule include a provision which establishes a rebuttable presumption based on (1) whether the tobacco in question meets 1 of the 4 objective standards set forth in the comment (2) whether the product was regularly sold under a pre-existing brand name, trade name or trademark predominately associated with pipe tobacco or r-y-o tobacco before 1-1-2009. Also, the comment proposed a taxpayer self-certification process modeled after that which TTB proposed in 2006 dealing with the classification of cigarettes and cigars. Also see the Pipe Tobacco Council's second comment, Comment 163, of October 24, 2011.
