Abstract: In this final rule, TTB amends its regulations regarding the standards of identity for distilled spirits to include "Cachaça" as a type of rum and as a distinctive product of Brazil. TTB undertook this rulemaking in response to requests from the Government of Brazil and subsequent discussions with the Office of the United States Trade Representative. An agreement between the United States and Brazil provides that once the U.S. recognizes Cachaça as a distinctive Brazilian product, Brazil will, within 30 days, recognize Bourbon and Tennessee Whiskey as distinctive products of the United States. The final rule is effective on April 11, 2013, and includes a 180-day use-up period for previously approved product labels that do not conform to the new standard of identity for Cachaça at 27 CFR 5.22(f)(1). The final rule also provides that the word "Cachaça" may be spelled with or without the diacritic mark (i.e., "Cachaça" or "Cachaca").
