§ 12.33 Exemption.
(a) Upon written request from the licensee, the Director of the Office of Energy Projects Division of Dam Safety and Inspections may grant an exemption from the requirements of this subpart D in extraordinary circumstances that clearly establish good cause for exemption.
(b) Good cause for exemption may include the finding that the development in question has no dam except dams , canal, or other water conveyance except those that meet the criteria for low hazard potential as defined by the Corps of Engineers in 33 CFR part 222.

(c) The Director of the Division of Dam Safety and Inspections, for good cause shown, may rescind any exemption from this subpart D granted by the Director, and may require that a comprehensive assessment be completed prior to considering a subsequent request for exemption from the licensee.
