AGENCY: Interstate Commerce Commission.
ACTION: Notice of Exemption.

SUMMARY: Under 49 U.S.C. 10505, the Interstate Commerce Commission
conditionally exempts from the prior approval requirements of 49 U.S.C.
10901 the construction and operation by the Burlington Northern
Railroad Company of 4.3 miles of track and the operation over an
additional 1 mile of track, in Butler and Platte Counties, NE.
DATES: The exemption will not become effective until the environmental
process is completed. At that time, the Commission will issue a further
decision addressing the environmental matters and establishing an
exemption effective date, if appropriate. Petitions to reopen must be
filed by January 31, 1995.
