Title: Exemption for Coal Extraction Incidental to Extraction of Other 
Minerals--30 CFR 702

Abstract: This part implements the exemption in Section 701(28) of the 
Surface Mining Control and Reclamation Act of 1977 (the Act), Public 
Law 95-87. It requires the regulatory authority to make a determination 
of exemption from the requirements of the Act for operators extracting 
less than 16\2/3\ tons of coal incidental to the extraction of other 
minerals. This information will be used by the regulatory authority to 
make that determination.
