Notice of Lodging of Consent Decree
Notice is hereby given that a proposed Consent Decree and
Settlement in United States v. Minnesota Mining and Manufacturing Co.,
Civil Action No. 95-CV-70860-DT (E.D. Mich.), entered into by the
United States, and Minnesota Mining and Manufacturing Co. (``3M''), was
lodged on March 8, 1995, with the United States District Court for the
Eastern District of Michigan. The proposed Consent Decree and
Settlement resolves certain claims of the United States under Sections
104 and 107 of the Comprehensive Environmental Response, Compensation,
and Liability Act (``CERCLA''), 42 U.S.C. Sec. Sec. 9604 and 9607, with
respect to the Montie Drums Site in Belleville, Michigan. Under the
Consent Decree, 3M will pay the United States $1,100,000, representing
one hundred percent of the government's claims for past response costs.
In addition, 3M will pay the United States $50,000 to settle civil
penalty claims arising from its alleged failure to fully and accurately
respond to information requests from the United States Environmental
Protection Agency.
The Department of Justice will receive comments relating to the
proposed Consent Decree and Settlement for 30 days following
publication of this Notice. Comments should be addressed to the
Assistant Attorney General, for the Environment and Natural Resources
Division, Department of Justice, P.O. Box 7611, Ben Franklin Station,
Washington, D.C. 20044, and should refer to United States v. Minnesota
Mining and Manufacturing Co., D.J. Ref. No. 90-11-2-834. The proposed
Consent Decree and Settlement may be examined at the Office of the
United States Attorney for the Eastern District of Michigan, 211 West
Fort Street, Suite 2300 Detroit, MI 48226, the Region V Office of the
United States Environmental Protection Agency, 77 West Jackson
Boulevard, Chicago, Illinois 60604; and at the Consent Decree Library,
1120 G Street, N.W., 4th Floor, Washington, D.C. 20005, (202) 624-0892.
A copy of the proposed Consent Decree may be obtained in person or by
mail from the Consent Decree Library, 1120 G Street, N.W., 4th Floor,
Washington, D.C. 20005. In requesting a copy, please enclose a check in
the amount of $6.00 (25 cents per page for reproduction costs), payable
to the Consent Decree Library.
