Approval and Promulgation of Implementation Plans and Designation
of Areas for Air Quality Planning Purposes; Indiana
AGENCY: Environmental Protection Agency (USEPA).
ACTION: Proposed rule.

SUMMARY: The USEPA is proposing to approve requests to redesignate
Indiana marginal ozone nonattainment areas to attainment. The USEPA is
also proposing to approve accompanying maintenance plans as State
Implementation Plan (SIP) revisions. The redesignation requests and
maintenance plans were submitted by the Indiana Department of
Environmental Management (IDEM) for the following ozone nonattainment
areas: St. Joseph and Elkhart, Vanderburgh and Marion Counties. The
State has met the requirements for redesignation contained in the Clean
Air Act, as amended in 1990. In the final rules section of this Federal
Register, the USEPA is approving the State's redesignation requests and
the supporting maintenance plans without prior proposal because USEPA
views these as noncontroversial revisions and anticipates no adverse
comments. A detailed rationale for the approvals is set forth in the
direct final rule. If no adverse comments are received in response to
that direct final rule, no further activity is contemplated in relation
to this proposed rule. If USEPA receives adverse comments, the direct
final rule will be withdrawn and the public comments received will be
addressed in a subsequent final rule based on this proposed rule. A
second comment period on this action will not be held. Parties
interested in commenting on this notice should do so at this time.
Adverse comments received concerning a specific geographic area, St.
Joseph and Elkhart, Vanderburgh or Marion Counties, will only affect
the final rule as it pertains to that area and only the portion of the
final rule concerning the area receiving adverse comments will be
withdrawn.
