§ 700.12 Contract provisions.
(a) The non-Federal entityrecipient or subrecipient's contracts must contain the applicable provisions described in Appendix II to Part 200—Contract Provisions for non-Federal Entity Contracts Under Federal Awards200.
(b) All negotiated contracts (except those for less than the simplified acquisition threshold) awarded by the non-Federal entity recipient or subrecipient must include a provision to the effect that the non-Federal Entityrecipient or subrecipient, USAID, the Comptroller General of the United States, or any of their duly authorized representatives, must have access to any books, documents, papers and records of the contractor which are directly pertinent to a specific program for the purpose of making audits, examinations, excerpts and transcriptions.
