I am AGAINST the change proposed in this proposed BLM rule, entitled:
Land Withdrawals; Removal of Regulations Covering Emergency Withdrawals
I have been a government employee and continue to hold government employees in
high regard. But, the way this rule change is being approached is nothing short
of reprehensible.
Release of this rule change near the end of a Presidential administration, with
so few days to comment AND, in particular, with a Federal holiday (10/13/2008)
included within the comment period is nothing short of a blatant violation of the
spirit of a government "for the people" entrusted with overseeing the lands
owned by we, the people.
With regard to the rule itself, I believe the current rule provides necessary
governmental checks and balances that should not be erroded. Clearly, the
Constitution's interpretation is fluid and evolving. Thus, in my opinion, the
arguments supporting the rule change contained within the proposal document do
not show sufficient justification for changing this rule.
