EFFECTIVE DATE OF PROPOSED RULE
Throughout this document, CMS states that application fee and other previsions are effective on March 23, 2011, and while I understand that Congress intended for these provisions to take effect on March 23, 2011, CMS must complete the notice and comment rulemaking process before it can levy the new Medicare enrollment tax on providers and suppliers. Therefore, I recommend that CMS implement the application fee or Medicare enrollment tax only after a Final regulation has been issued and the public has been given at least 60 days notice.
