After reviewing the Virginia Graeme Baker Pool and Spa Safety Act; Public Accommodation proposal by the Consumer Product Safety Commission I would have to agree on the proposal put forth. It seems highly reason to define “public accommodation” as proposed. As stated in the proposal “public accommodation” is defined by The Americans with Disabilities Act, The Civil Rights Act, and Consumer Product Safety Improvement Act as ‘‘an inn, hotel, motel, or other place of lodging, except for an establishment located within a building that contains not more than five rooms for rent or hire and that is actually occupied by the proprietor of such establishment as the residence of such proprietor’’. Being that the definition is the same for these three highly recognizable federal statutes the same should be implied to the Virginia Graeme Baker Pool and Spa Safety Act.
