§ 39.1 Scope.

The provisions of this subpart A apply to any derivatives clearing organization, as defined under section 1a(15) of the Act and § 1.3 of this chapter which , that is registered or deemed is required to be registered register with the Commission as a derivatives clearing organization , is required to register as such with the Commission pursuant to section 5b(a) of the Act, or which voluntarily applies to register as such with the Commission that is applying for an exemption from registration pursuant to section 5b(b) or otherwiseh) of the Act.
